Can I claim more compensation than I pay monthly?

Yes! TKG § 58 compensation is not capped. At 20% of your monthly fee per day from day 5, compensation exceeds your monthly fee after just 5 days. Example: At €40/month, compensation is €8/day — after one week that's already over €40.

What's the difference between compensation and fee refund?

Compensation (TKG § 58) is a penalty payment by the provider. Fee refund (Minderungsrecht) is the proportional refund for undelivered service. You're entitled to both.

Do I need to report the outage immediately?

Yes, you should report the outage immediately. The 2-day grace period only starts when you report. The sooner you report, the sooner your compensation claim begins.

Does TKG § 58 apply to speed issues?

No, TKG § 58 only applies to a complete outage. For speed issues, there are other rights under TKG § 57 (reduction right for non-contractual performance).

What evidence do I need?
